| Summary: | <p><strong>Resumo</strong></p> <p>A história dos séculos XX e XXI demonstra que o retorno do direito e do estado, associados ao reconhecimento e à proteção dos direitos humanos, traduz mudança qualitativa nos sistemas jurídicos e políticos. Os direitos não são nem o reflexo da reprodução de ciclos históricos passados nem tampouco a dedução dos direitos humanos da constituição. Eles são um tipo específico de discurso com função prático-social.</p> <p><strong>Palavras-chave: </strong>Direitos Humanos; Ciências Sociais; Poder Judiciário; Ideologia; Discurso.</p> <p><strong> </strong></p> <p><strong>Abstract</strong></p> <p>The history of the XX and XXI centuries shows that the return of the law and the state, associated with the recognition and protection of human rights, represents a qualitative change in legal and political systems. The rights are neither a reflection of past historical reproduction cycles nor the deduction of the human rights of political constitutions.
